Red Flag 1: The seller cannot produce original documents. If original title deeds, JP approval certificates, or encumbrance certificates are 'with the bank' or 'at home' and unavailable for inspection, walk away. No legitimate seller has difficulty producing original documents at the time of negotiation.
Red Flag 2: Approval described as 'in process'. JP approval either exists or it doesn't. 'We expect it in three months' is not a legal basis for purchasing land at approved-plot prices. You are taking on the approval risk at no discount.
Red Flag 3: Ownership chain gaps. The title deed should show a clear chain of ownership from the original land grant to the current seller. Any gap — years where the ownership is unexplained — requires investigation. Gaps often indicate disputed transfers, inheritance conflicts, or fraudulent entries.
Red Flag 4: EC shows active loans. An encumbrance certificate (EC) obtained from the Sub-Registrar's office will show all registered transactions on the property, including mortgages. If the current owner has a mortgage on the property, it must be discharged before you can take clean title.
Red Flag 5: Survey number doesn't match. The plot's survey number (Khasra number) on the title deed must exactly match the government land records (Khatauni). Discrepancies suggest the physical plot being sold may differ from the legal plot on paper.
Red Flag 6: Seller insists on cash transaction. Legitimate plot sales include a registered sale deed — a public record of the transaction. Sellers who want significant portions paid in cash are typically avoiding tax, hiding encumbrances, or both. Your protection as a buyer depends on a complete registered transaction.
